Our Managing Partner, Mihaela Nyerges shared the first panel of the ๐ฅ๐ผ๐บ๐ฎ๐ป๐ถ๐ฎ๐ป ๐ฅ๐ฒ๐ป๐ฒ๐๐ฎ๐ฏ๐น๐ฒ ๐๐ป๐ฒ๐ฟ๐ด๐ ๐ฆ๐๐บ๐บ๐ถ๐ ๐ฎ๐ฌ๐ฎ๐ฐ with representatives from the Ministry of Energy and other esteemed energy professionals. Good discussions on some of the most pressing topics in Romania's energy sector, including CfD, upcoming support schemes, grid connection changes and challenges, agrivoltaic projects, investorsโ perspectives on the market and so much more.

๐ถ ๐๐ผ๐ป๐๐ฟ๐ฎ๐ฐ๐๐ ๐ณ๐ผ๐ฟ ๐๐ถ๐ณ๐ณ๐ฒ๐ฟ๐ฒ๐ป๐ฐ๐ฒ (๐๐ณ๐) are currently a key focus for both investors and financial institutions. Aspects of the auction process require further clarification from the Ministry of Energy and TSO, such as documentation of financial capacity, relevant experience, specific formalities for consortium bids. ๐ฅ๐ฃ๐๐ and ๐ฅ๐ช๐๐ have established a working group dedicated to preparing a list of clarifications to be sent to the Ministry of Energy.
๐ถ ๐ฅ๐ฒ๐ฐ๐ฒ๐ป๐ ๐ฐ๐ต๐ฎ๐ป๐ด๐ฒ๐ ๐๐ผ ๐๐ต๐ฒ ๐ด๐ฟ๐ถ๐ฑ ๐ฐ๐ผ๐ป๐ป๐ฒ๐ฐ๐๐ถ๐ผ๐ป ๐ฝ๐ฟ๐ผ๐ฐ๐ฒ๐๐ have already had a positive impact, providing investors with tools to safeguard their projects if building permits are delayed for reasons beyond their control. Nonetheless, challenges remain in implementation, as we have already encountered a rejection by the grid operator of an extension request for one of our clients, which was positively resolved only after initiating the dispute settlement process.
๐ถ ๐๐ป๐ฐ๐ฟ๐ฒ๐ฎ๐๐ฒ๐ฑ ๐๐ฟ๐ฎ๐ป๐๐ฝ๐ฎ๐ฟ๐ฒ๐ป๐ฐ๐ ๐ฟ๐ฒ๐ด๐ฎ๐ฟ๐ฑ๐ถ๐ป๐ด ๐ด๐ฟ๐ถ๐ฑ ๐๐๐ฎ๐๐๐ is anticipated once ANRE begins publishing reports based on updated grid status data submitted monthly by grid operators.
๐ถ ๐ฆ๐ผ๐บ๐ฒ ๐ด๐ฟ๐ถ๐ฑ ๐ผ๐ฝ๐ฒ๐ฟ๐ฎ๐๐ผ๐ฟ๐ ๐ถ๐ป๐๐ฒ๐ฟ๐ฝ๐ฟ๐ฒ๐ ๐๐ต๐ฒ ๐ป๐ฒ๐ ๐ฐ๐ผ๐ป๐ป๐ฒ๐ฐ๐๐ถ๐ผ๐ป ๐ฟ๐๐น๐ฒ๐ ๐ฑ๐ถ๐ณ๐ณ๐ฒ๐ฟ๐ฒ๐ป๐๐น๐, for instance, by requiring a 5% guarantee for any ATR update, not just when evacuation capacity increases, or by waiving the 5% guarantee at ATR issuance if the solution study had already been endorsed when the new rules took effect. We are working on a formal request for clarification from ANRE to ensure the law is applied correctly and ATRs are issued in a valid manner.
๐ถ We are hopeful that the Government will soon pass the ๐ฑ๐ฒ๐ฐ๐ถ๐๐ถ๐ผ๐ป ๐ผ๐ป ๐ฑ๐๐ฎ๐น-๐๐๐ฒ ๐ผ๐ณ ๐ฝ๐ฎ๐๐๐๐ฟ๐ฒ๐ following recent public consultations and that this will suffice for the Ministry of Agriculture to unblock these projects.
